What are the main changes proposed in the Draft Planning Proposal?

    • Amend the land use zone from the current RU4 Primary Production Small Holdings Zone to a mix of the following:
      • R2 Low Density Residential;
      • R5 Large Lot Residential;
      • RE1 Public Recreation;
      • C3 Environmental Management;
      • C2 Environmental Conservation;


    • Amend the minimum lot size for subdivision from the current 2 hectare minimum lot size to achieve a range of lot sizes as follows:
      • 700 square metres for land zoned R2;
      • 975 square metres, 1500 square metres and 4000 square metres for land zoned R5;
      • One Hectare for land zoned C3;
      • That a minimum lot size for the remaining C2 zoned land be commensurate to the amount of zoned land.


    • Amend the maximum building height to a building height of 6.8 metres for the south-eastern lobe of the site, and a maximum building height of 9 metres for the remainder of the site.


    • Amend Wollondilly Local Environmental Plan 2011 to enable a Water Treatment Facility to be constructed on the site (in order to provide a wastewater treatment option for future dwellings).

    What is a Planning Proposal

    A Planning Proposal is a document and supporting information that explains the intended effect and justification of proposed amendments to a Local Environmental Plan. In this case, the Wollondilly Local Environmental Plan 2011.

    What is the process for preparing a Local Environmental Plan?

    The plan making process normally involves the following key components:

    • the preparation of a planning proposal;
    • the issuing of a Gateway Determination by the NSW Government;
    • community and other consultation on the proposal;
    • legal drafting of the LEP (Legal Instrument);
    • making the plan;
    • notifying the LEP on the NSW Government Legislation website

    What is a Gateway Determination?

    A planning proposal, once prepared, is forwarded to the Minister for Planning and Public Space or the Greater Cities Commission (GSC) for Gateway consideration.

    A Gateway Determination is issued by the Minister, GSC or delegate. The Gateway Determination will generally include the following:

    • whether the Planning Proposal should proceed (with or without variation);
    • whether any studies are required;
    • whether the proposal should be resubmitted for any reason;
    • the community consultation requirements;
    • any consultation required with state or commonwealth authorities;
    • whether a public hearing is to be held;
    • the timeframe for completing the various stages of the process for making the proposed LEP;
    • whether the function of making the LEP is to be exercised by the Minister, GSC or delegated to the Council (or another authority).

    Is my submission confidential?

    Council may be required to release written comments or submissions to an application under the Government Information (Public Access) Act 2009 or the Local Government Act, 1993, which impose obligations on us to release documents in certain circumstances.
