Proposed Rezoning - Brooks Point Road, Appin

Preliminary Consultation - Open for Feedback

Council has received a draft Planning Proposal seeking to rezone land on Brooks Point Road, Appin, for residential development, and conservation.

The proposed site comprises:

  • Lots 1, 3, 4 & 5 DP 249446; and
  • Lot 1 DP 584515

The site is 39 hectares and is located to the south of Appin village. It adjoins Appin Road to the east, Brooks Point Road to the south, Ousedale Creek to the west and Appin village to the north.

The proposal seeks to rezone land from RU2 Rural Landscape to R2 Low Density Residential and C2 Environmental Conservation. This is expected to yield approximately 200 to 250 lots to facilitate low and medium density residential development.

The proposal seeks the following changes:

  • Land use from RU2 Rural Landscape to R2 Low Density Residential and C2 Environmental Conservation
  • Lot Size change from 40ha to 450m² in the R2 Low Density zone and 40 hectares in the C2 Environmental Conservation area
  • Height of Buildings changes for a maximum building height of 9m.

It is important to note the following:

  • This is not the first time this proposal has been notified. A preliminary notification took place early 2023 and was reported to the Local Planning Panel, followed by a report to Council. That Planning Proposal was not supported to proceed to Gateway determination from the NSW Department of Planning, Housing and Infrastructure.
  • A proponent may resubmit a planning proposal. This can happen for a number of reasons, including if they believe circumstances have changed.
  • Council is obliged to assess any planning proposal and follow the same process of preliminary notification to seek agency and community feedback.
  • The elected Council has not yet considered or formed a view on this current proposal.


We are now seeking community feedback prior to the proposal being assessed and being reported to the Local Planning Panel and Council. These assessment reports will include community feedback received during this preliminary notification period.

To help guide the Planning Proposal process and ensure Appin is a place where people can live happily and healthily, Council would like to hear your thoughts on key elements of the concept.
